Stage 1 - Finding a Business Premises

Our preferred approach to finding you an ideal business premises involves us:

  • Understanding your business values, operations and mid-to-long term goals

  • Agreeing with you the preferred market(s) and specific terms and requirements for the tenancy

  • Undertaking market research and making enquiries through leasing agents

  • Developing and inspecting a shortlist of possibilities

  • Offering you a shortlist and taking you through the premises

 

Stage 2 - Negotiating a Heads of Agreement

In our experience, Heads of Agreement are all too often drafted insufficiently. This can lead to disagreements when it comes to drafting the lease terms, after additional costs have been incurred. The result is that the lease often falls over. To avoid disappointment and protect your interests, we believe that a Heads of Agreement should be comprehensive and clearly outline terms that are important to you. This approach can also help you ensure that the lease agreement doesn’t leave you exposed to any unexpected costs that are sometimes hidden in market review, recovery of outgoings, option and make good clauses, to name a few.

Stage 3 - Concluding the Legal Documentation

This is an often underrated and costly part of completing a lease. It involves both landlord and tenant’s solicitors trying to draft the best terms for their client.

We understand the approach taken by landlord’s solicitors and are highly experienced in briefing and managing lawyers to ensure that the Lease reflects the Heads. No one is bound to the terms agreed in the Heads until they are reflected in a signed Lease. This process does require careful management and pressure to be concluded quickly.
